1. Introduction

Welcome to Ocean's Elegance Yacht Club ("we," "us," or "our"). The following Terms & Conditions ("Terms") apply to your use of our yacht charter services, including our website at globalcultureexchange.sbs operated by Ocean's Elegance Yacht Club.

By securing a booking or using our Service, you are consenting to these Terms. If you do not accept any part of the terms, you should not access the Service.

2. Service Overview

At Ocean's Elegance Yacht Club, we offer a range of luxury yacht charter services including, but not limited to:

• Day-to-day yacht hire
• Evening sailing experiences
• Business team outings
• Exclusive gatherings
• Extended yacht journeys

Our services are offered based on availability and are subject to the prevailing weather conditions. We maintain the right to adjust or cease offerings at our discretion.

3. Booking and Reservations

3.1 Booking Process

For a successful booking, you must:

• Have attained the age of 18 years
• Provide truthful and accurate details
• Remit a deposit as detailed in your reservation confirmation
• Accept these Terms & Conditions

3.2 Confirmation

A reservation is only confirmed with the processing of your payment and our subsequent written affirmation. We retain the right to decline service at our discretion.

3.3 Availability

Boat charters are dependent on the availability of vessels and favorable weather conditions. We will endeavor to honor your preferred scheduling within reason.

4. Payment Terms

4.1 Pricing

All listed charges are in € and include taxes where applicable unless specified differently. Pricing is subject to alteration without prior notification.

4.2 Payment Schedule

• Deposit: 50% of the full charter fee is required at the time of booking
• Final Payment: Due 48 hours prior to the departure of the charter
• Additional fees (when applicable): Payable at the end of the charter

4.3 Payment Methods

We accept various forms of payment, including but not limited to major credit cards, wire transfers, and bank-certified cheques. We process all payments using secure and encrypted means.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• Greater than 72 hours from the time of departure: Full refund, less any processing fees
• Between 24 to 72 hours prior to departure: Refund of 50% of the total amount
• Under 24 hours before departure: No refund will be issued

5.2 Weather Cancellations

If our captain considers the weather conditions to be unsafe, we will propose to:

• Move your charter to an alternate date at no extra cost
• Process a full refund should rescheduling not be an option

5.3 Mechanical Issues

In case of mechanical failure with your designated vessel, we will make an effort to provide a comparable replacement. If no other vessel is available, we will issue a complete refund.

6. Safety and Conduct

6.1 Safety Requirements

All participants on board must:

• Heed all directives from the crew
• Make use of safety gear when deemed necessary
• Disclose any health conditions that could affect their safety
• Stay within the areas allocated on the yacht

6.2 Prohibited Items

The following are barred from the yacht:

• Containers made of glass
• Illicit materials
• Guns or any form of weaponry
• Excessive quantities of drinks other than soft drinks and lemonade
• Animals, unless given prior consent

6.3 Conduct

Passengers are expected to behave in a courteous and respectful way. We reserve the right to end a charter prematurely and without a refund in case of misconduct that endangers safety or undermines the enjoyment of other guests.

7. Liability and Insurance

7.1 Our Liability

Our financial responsibility is restricted to the sum paid for your charter. We are not accountable for:

• Injury incurred due to personal neglect
• The theft or harm of personal items
• Non-direct, unintended, or punitive damages
• Delays stemming from weather or events not within our control

7.2 Insurance Coverage

We maintain extensive nautical insurance covering our fleet and operations. It is incumbent upon passengers to ensure they have adequate travel and personal insurance coverage.

7.3 Assumption of Risk

You recognize Marine activities come with intrinsic hazards by choosing to partake in our charter services, and you accept personal responsibility for your safety and well-being.

8. Modifications and Itinerary Changes

We hold the right to modify itineraries, pathways, or timetables due to considerations of weather, safety, or operational necessities. Every endeavor will be made to deliver an experience comparable to the original plan.

9. Force Majeure

We cannot be held responsible for hold-ups, cancellation, or changes brought about by circumstances out of our control, such as, but not restricted to:

• Severe meteorological events
• Catastrophic phenomena
• Official mandates
• Port closures
• Vessel failure and breakdowns

10. Privacy and Data Protection

We treat your private data according to our Privacy Policy. Engaging with our services indicates your assent to the accumulation and utilization of your data as set forth in our Privacy Policy.

11. Intellectual Property

Content on our website is under copyright and trademark protection. You may not reproduce, broadcast, or generate works deriving from our material without explicit permission from us.

12. Governing Law

These Terms are under the jurisdiction of the laws of Spain. Any disputes will be settled in the courts situated in Barcelona, Spain.

13. Changes to Terms

We retain the authority to revise these Terms at will. Any amendments will be published on our website, displaying the date of the newest update. Continued engagement with our services implies consent to the updated terms.
